Introduce a new concept of distributing duties among the state institutions involved in the organisation and conduct of elections abroad. According to this concept, the CEC would be responsible for the process, with the assistance of the MFAEI.

Amend Article 291 of the Electoral Code to establish three indicators as the legal basis for identifying the number and geographic distribution of polling stations abroad: the number of voters who participated in the previous election; statistical data in the State Registry of Population on the number of Moldovan citizens who have permanent residency abroad; and prior registration of citizens abroad.

Modify Article 27 of the Electoral Code to allow PSs abroad to perform their work under a separate constituency. There is a need to expressly establish an ECC in charge of conducting voting abroad.

Eliminate the requirement that local public authorities authenticate signature sheets in national elections. Promo-LEX EOM has demonstrated the inefficiency of signature sheet authentication in this report. This change would allow a more inclusive approach towards the citizens with the right to vote abroad and on the left bank of Nistru River who would like to sign the lists.

Amend the Electoral Code with regard to the maximum number of ballot papers allowed in PSs abroad. This presidential election showed that up to 6,000 ballot papers can be processed at a PS.

Consider the explicit legal regulation of the organised transportation of voters, including from the perspective of the risk of voter corruption.

Amend the Electoral Code to explicitly regulate appeal procedures and the resolution of complaints by electoral bodies and courts of law. In particular, the following should be considered in presidential elections: opportunities for submitting complaints during signature collection, the competence of the CEC to review these appeals, the opportunity to submit complaints during vote tabulation regarding voting results in a particular PS, etc.

Supplement the Electoral Code with an express provision obligating the CEC itself to take action in cases of violations of electoral legislation.

Approve a revision of the Article 181(1) of the Criminal Code supplementing the list of goods that cannot be offered to the voters, and applying the provisions of this article to presidential elections.

Explicitly regulate the categories of persons entitled to collect signatures in support of nominated candidates. Impose sanctions for the collection of signatures by unauthorised persons.

Amend the legal framework by introducing conditions of incompatibility for the leaders and/ or members of IGs

Extend the practice of requiring the submission of signature lists for the registration of nominated candidates (currently required in presidential elections) to other types of elections.

Amend the Electoral Code in order to homogenise the rules for establishing electoral blocks in all types of elections. The rules used to nominate candidates for parliamentary elections could serve as a reference.

Change electoral law on the registration of candidates in Moldovan presidential elections to ensure all candidates have an equal amount of time for their election campaigns

Amend the Electoral Code and the Law on Political Parties in order to establish a method of keeping records and verifying political party membership in order to prevent political activity by members of electoral bodies, and apply sanctions if appropriate.

Adjust the Russian version of the Electoral Code to coincide with the Romanian version (for instance, Article 40(1)) in order to avoid any misunderstandings when applying the law.

Provide for the participation of students/pupils with the right to vote in the electoral process by applying sustainable and generally applicable provisions for all types of elections.

Define and explain the phrase “and other socio-political organisations” from the Electoral Code as it relates to the Law on Political Parties.

Supplement the Law on Personal Data Protection with rules ensuring the transparency and accessibility of voter lists and the transparency of donors’ workplaces in candidates’ financial statements.

Change the approach to determining the minimum number of signatures on the signature sheets for a second-level administrative territorial unit, both for presidential elections and for other types of elections or referendums. The minimum number should be quantified in percentage values (1% or 2%) relative to the total number of voters from that ATU, rather than in absolute numbers.

Improve the legal framework by establishing the exact schedule and procedures regulating the continuation of the election campaign to a second round.

Explicitly regulate the exercise of the right to vote using expired identity documents.

Eliminate the obligation of candidates for the position of President of the Republic of Moldova to include information about their residence on signature sheets; amend Article 42(3) of the Electoral Code and enforce its provisions for other types of elections and referendums.

Supplement Article 29(11) of the Electoral Code with provisions on the incompatibility of EOPS membership with the mandate of mayor.

Supplement the Electoral Code with provisions on the status of “Elections” SAIS operators as persons authorised to participate in electoral operations. Regulate the incompatibility of the capacities of observer and party member or elected local official.

Amend the legal provisions regulating the method of calculating the percentage value of the votes expressed in support of election candidates in the election of the President of the Republic of Moldova, in order to adjust the formulations for other elections.

Amend the Electoral Code by adjusting the Instructions for the CEC on mobile voting in order to develop a clear mechanism offering voters who vote at their residences equal opportunities for replacing incorrectly-completed ballots just like voters who vote at polling stations.

Amend Article 27(6) of the Electoral Code to make incompatible the capacities of party member and ECC member nominated by a political party that is in Parliament.

Regulate promotional advertising during the signature collection campaign.

Supplement the regulatory framework in order to clearly regulate the involvement of nonresident service providers in the Republic of Moldova in election campaigns.

Explicitly regulate the work of private foundations associated with politicians during the election period.

Review the thresholds for donations from individuals and legal entities to election candidates and political parties by reducing them to correspond with the average standard of living.

Supplement Article 38(1) of the Electoral Code by introducing a clear procedure and schedule for appointing the people responsible for election candidates’ finances (treasurers).

Change the legal framework to make ‘Electoral Fund’ bank accounts permanent in order to get rid of uncertainties and possible delays related to opening the accounts.

Change the legal framework to prohibit paid electoral advertising and to increase free air time from public mass-media institutions, including for broadcasting electoral debates.

Change the legal framework to prohibit outdoor electoral advertising (outdoor billboards, city light, mobile panels, posters etc.).

Supplement electoral law to limit, prohibit or strictly regulate donations from legal entities that provide goods or services to any public administration, in line with GRECO standards.

Apply the legal provisions on the punishment of illegal electoral campaign financing, namely Article 181(2) of the Criminal Code, to initiative groups collecting signatures for candidates nominated in a national elections and referendums as well.

Change legislation in order to regulate the ability of Moldovan citizens living abroad to fund candidates’ election campaigns.

Explicitly regulate the financial accounting for donations both during the election period and in the period between elections, so recording these donations does not burden or delay the work and banking operations of those concerned.

Initiate and organise public discussions on mechanisms for ensuring that voters who are abroad on the day of the election have the right to vote.

Sanction the Metropolis of Chisinau and All Moldova for violations of the law by clerics who publicly shared their political preferences and supported a particular candidate during the presidential campaign. Apply sanctions uniformly, in accordance the law, to all religious organisations that were politically involved.

Ensure more effective and a real-time communication with the external environment, including by updating operatively the institution’s website.

Simplify the requirements for compiling IG member lists and the signature sheets. Ensure the transparency of signature sheet verification.

Conduct a plenary report on the establishment and management of the State Registry of Voters.

Ensure the continuity and sustainability of the process of verifying lists, as well as their quality.

Monitor the activity of lower electoral bodies in order to identify incompetent electoral officials. Those officials should be removed from the REO and should not to be involved in electoral activities in subsequent elections.

Ensure the proper functioning of SIAS ‘Elections’.

Make more transparent the mechanisms for establishing and filling in the Registry of Electoral Officials

Establish a platform for sustainable communication with organisations for people with special needs (hearing, vision, locomotion, etc.) in the RM, in order to inform them about the electoral developments in due time and receive specific requests from them to make the electoral process accessible.

Establish mechanisms to ensure that people sentenced to imprisonment have the ability to be informed about election campaigns and election candidates’ platforms just like other citizens.

Monitoring the implementation of recommendations on the provision of polling station infrastructure.

Establish a ECC for the polling stations where RM citizens residing in the districts on the left bank of Nistru River (beyond the constitutional control of RM authorities) can exercise their right to vote.

Check and ensure compliance with legal norms on establishing the electoral offices of polling stations.

Monitor and ensure compliance with EOPS working hours.

Supplement the Regulation on the Activity of Electoral Offices of Polling Stations with an express provision requiring the electoral body to remove electoral posters within 100 meters of the polling station the day before the election.

Conduct an in-depth analysis of the expenses incurred by the IGs and apply appropriate sanctions in case of violations.

Ascertain and evaluate/estimate, in accordance with the guidelines of the Venice Commission, the unauthorized use of administrative resources by political parties or candidates as financial contributions to election campaign funds and report these cases in the appropiate way

Establish a more rigorous mechanism for checking the financial statements of election candidates.

Ensure transparency and accessibility to all data submitted to the CEC by election candidates during the election campaign, including donors’ workplaces, as indicated in the content of the report on campaign financing, by displaying these data on the institution’s website.

Reduce the threshold for donations that require verification by the Court of Accounts and the Main State Tax Inspectorate from 75.000 to 50.000, on the basis of reports made available.

Explicitly regulate the ability of political parties to finance election campaigns so that the identities of primary donors are included in the election candidates’ reports.

Apply sanctions to the mass media in accordance with the law and depending on the severity of infringements. Make media institutions responsible for reporting on the election campaign in an unbiased and fair way.

Avoid becoming involved in collecting signatures for signature sheets of certain IGs.

Avoid using administrative resources and public funds in the interest of a party or to promote certain candidates.

Ensure some decent conditions in polling stations during voting: lighting, heating, sanitation, etc

Ensure access for people with special needs (access ramps, polling stations located on the ground floor, etc.).

Observe CEC instructions on PS layout in order to provide voters with a clear path and instructions on the conditions for free observation of the electoral process.

Verify the accuracy of the completion of voting results forms according to the verification formulas embedded in the procedure.

Monitor the work of electoral bodies and other election candidates in order to challenge violations in accordance with the law. Raise awareness of the responsibilities of all categories of electoral actors.

Train supporters (Moldovan citizens with the right to vote) in advance, including them in the electoral process as observers, representatives with the consultative right to vote, and members of lower election bodies with the deliberative right to vote. In this way, frequent changes in the composition of ECC and EOPS will be avoided, and quality monitoring of procedures will be ensured.

Do not allow the use of administrative resources for collecting signatures and during election campaigns.

Cover expenses during signature collection using the bank account meant for Initiative Groups (IGs) only.

Observe the terms set by electoral authorities when opening the accounts for IGs.

Do not use unreported electoral funds and gifts in the period immediately prior to elections.

Ensure the transparency of revenue collection and expenses during the signature collection period.

Avoid the transfer of donations from legal entities or parties to the ‘Initiative Group Fund’ and ‘Electoral Fund’ accounts, ensuring transparency of donations and donors.

Register and report all donations received, including material (in-kind) donations, to the Central Electoral Commission in line with the best practices of the Council of Europe.

Report all expenses incurred during the election period, in accordance with both the law and the best practices of the Council of Europe.

Refrain from using printed materials with denigrating content addressed to rival candidates and from using negative PR in the election campaign.

Refrain from expressing discriminatory, sexist, xenophobic and homophobic messages and attitudes in the election campaign.

Avoid collective transportation of voters to polling stations on Election Day.

Investigate, in accordance with the provisions of contraventional and criminal law, cases concerning illegal campaign financing, voter corruption and the use of administrative resources for electoral purposes.

In future parliament should approve the electoral laws and amendments thereto involving experts and representatives of non-governmental organisations, to minimise the risk of imperfect laws and as a result their review in process of election campaign.

The CEC should promptly analyse the causes of difficulties in delays in publication of CEC’ decisions and in access to analytical information system "Vybory" take measures to eliminate them.

In future either the procedure of forming DECs and PECs should be reviewed or the option of replacing committee members on requirement of subjects who nominated them should be limited, due to Candidates for the President being irresponsible in nominations of the DECs' and PECs' members, which is confirmed with a significant number of replacements of DECs' members, because this involves massive confusion in the work.

In the future, CEC’s role in provision of providing election process security (first of all, coordinative role) should be reinforced, in particular by making amendments to the laws which that regulate CEC powers.

In the future, legislators should amend the law “On Eelections of the President of Ukraine” to prevent frequent changes the composition in election commissions' composition.

It is necessary to exclude the possibility of using administrative resources in collecting signatures, in particular, to prohibit the collection of signatures by unauthorized persons. In addition, it is necessary to provide for the right of observers to be present during the verification of signatures submitted for the nomination of candidates.

For the sake of increasing the transparency and accountability of the voter registration process, it is necessary to create a national voter list. Citizens and observers (including election agents, media representatives and international observers) should enjoy full access to the list. Every citizen shall have the right to have access to voter list before voting. In addition, observers should be able to have access to these lists during voting. The number of voters registered at the polling station should be announced by the election commissions before voting and after its completion. It is necessary to create a single register of all voters of the Republic of Belarus.

The Electoral Code allows the CEC to independently administer the state budget funds for the production of information leaflets with the general information about the candidates, instead of financing costs associated with the candidates’ printed campaign materials. This resulted in a low activity of most of the candidates in the production of campaign materials. Therefore, it is necessary to re-enforce at the legislative level the state funding of candidates’ costs of printed campaign materials. This should include the possibility of opening special funds from the moment of registration of nomination groups for the payment of expenses associated with collecting signatures for the nomination of the candidates, by analogy with the presidential election.

The legislation provides a period of no more than 1 month for the duration of the election campaign. This rule limits both the candidates’ opportunity to campaign and the citizens’ right to obtain full information about the candidates and their election platforms. It is proposed to extend campaigning period for up to at least two months. In addition, it is necessary to discharge the entities in charge of political advertising of any liability for the content of advertising provided by the candidates or political parties.

The Electoral Code provides for a limited list of grounds for submitting appeals to the courts. It is necessary to provide for the possibility of judicial review of any decisions by election commissions and other state bodies in matters relating to elections. First of all, it is necessary to allow the judicial review of decisions of the DECs, which approve the election results

The procedure for early voting in its current form allows the authorities to carry out various manipulations during the vote count. In this connection, it is proposed to consider the complete abolition of early voting. If early voting is not canceled, it is proposed to introduce criteria, compliance with which gives the voter the right to vote early. Such criteria should be grounds, which clearly prove the impossibility for the voter to vote on Election Day, e.g. a departure abroad or other documented evidence.

The legislation should also specify in detail the procedure for the storage of ballot boxes during early voting and the sealing of the premises where the ballot box is stored. It is necessary to prohibit the presence of unauthorized persons, including police officers, in the voting premises and rooms, in which the ballot boxes, ballots and other election materials are stored. It is also necessary to provide for the right of observers to be present on the premises for voting outside the working hours of election commissions (lunch break, period after the end of voting) in cases when members of the election commissions choose to stay.

Every PEC should be provided with single-part transparent ballot boxes with plastic tapes for sealing (with individual polling station numbers). Online surveillance throughout the days of early voting should be organized. Every PEC should also be provided with individual seals bearing an individual number. The security of ballots should be provided with corresponding signs.

It is necessary to determine that the right to mobile voting should be enjoyed by persons with significant health problems (documented by certificates issued by a healthcare institution), which prevent them from arriving at the polling station. The Electoral Code should specify that the citizen’s right to vote under mobile voting procedures only occurs after the transfer to the PEC on Election Day of a written request about the impossibility of voting at the polling station.

The current counting procedure is not transparent. One of the main reasons for this is the absence of a detailed description of the vote counting process in the Electoral Code. In this connection, it is necessary to legislate the following principles of the procedure of vote counting: counting of the votes shall be carried out publicly in the presence of observers who can monitor the accuracy of the voters’ choice on each ballot (i.e. to see the content of each ballot); counting of the votes shall be conducted by one of the commission members, who shall announce the voter’s choice and display each ballot to all the commission members and observers; counting of the votes shall be separate for each ballot box, and the results of separate counting of the votes shall be reflected separately for each ballot box in the final protocol. A copy of the final protocol shall be certified by the chairperson and secretary of the election commission, secured by the commission’s seal and issued to the observers at their request. It is also proposed to legislate the right of observers and candidates’ agents registered with the TECs to attend and observe the procedures for the transfer of ballots and protocols with voting results from the polling stations to the TECs.

It is necessary to provide for the possibility of publishing on the website of the CEC of voting results in all electoral districts with separate voting results for each polling station.

In order to strengthen confidence in the elections in Belarus, it is necessary to expand the rights of observers through amending electoral legislation. The observers should enjoy the right to access the materials of the commissions relating to its composition, the types of nomination of its members, voter lists, storage of ballots and ballot boxes during early voting, as well as to use video and photo equipment during the implementation of election observation.

Authorities should carry out a thorough investigation of all complaints and violations that took place during all stages of the elections, and hold accountable all responsible persons, including local executive authorities, who interfered in the election process.

The recommendations of local and international institutions on the improvement of the Election Code, including those of the Venice Commission of the Council of Europe and the OSCE/ODIHR, should be properly addressed by the government.

The pre-election campaign period should be extended.

The current administration should improve its relations with the opposition in order to curb political polarization.

All political prisoners should be immediately released and necessary conditions for the free operation of non-government organizations should be established

Election commissions should be formed on the principle of parity with representatives from all political parties

Rules for the nomination and registration of candidates should be simplified, and the financial deposit system, an alternative method of candidate registration, should be restored;

All political parties should be guaranteed equal access to the media

Serious actions should be undertaken to guarantee the freedoms of assembly, association, and expression.

All persons violating the election rights of citizens, particularly the local executive authorities should be held liable for their actions.

Authorities should take necessary steps for improvement of the Election Code and democratization of election environment in consultation and cooperation with domestic and international organizations.

The government should demonstrate political will to restore mutual confidence in relations between the state and public, release all political prisoners, take necessary measures to ensure freedoms of speech, assembly and association, create conducive environment for civil society and political parties to take active, meaningful and free participation in the governance process in order to solve the current political crisis.

The election commissions should be formed based on political parity principle in order to ensure their independence.

The government should ensure to address the shortcomings in the assessment of the Referendum results, as well as in the Election Code and other relevant legislation including the rules for filing complaints regarding the violation of the election rights.

Norms of national legislation restricting right to freedom of expression as well as provisions punishing persons on charges of defamation such as blocking of websites should be removed, Seymur Hazi, Afgan Mukhtarli, Mehman Huseynov, journalists, arrested on politically motivated charges should be released.

The serious measures should be taken on ensuring the freedom of assembly and association, legislation restricting operation and financing of civil society organisations and political parties should be improved, 130 persons who are considered political prisoners should be released.

The government should take measures by building trust between political sides in order to prevent political polarization in the society, ensure participation of public organizations and political groups in administration of state.

The initiatives and recommendations of Venice Commission as well as OSCE/ODIHR should be supported on improving Election Code, election commissions should be formed on the principle of parity with representatives from all political parties.

Clear and simple rules on updating voter lists should be put forward, the contradiction between the figures of demographic statistics of people and voter lists should be removed.

Central Election Commission should set out initiatives on online accreditation of observers and lift all restrictions on this matter.

The democratic and advanced rules should be established on filing complaints with the judicial and non-judicial bodies.

Nomination and registration of candidates should be simplified, the financial deposit system as an alternative method of candidate registration, should be restored.

Pre-election campaign period should be extended, during interelections and pre-election period access to media should be ensured for all political parties.

Political will should be demonstrated on the implementation of the judgements of the European Court of Human Rights on violation of right to free elections, those who are responsible for the violation of this right should be held accountable and ousted from their position.

The Electoral Code should be amended and the Precinct Commissions should be composed based on the same principle of impartiality of the CEC and TECs where no party member can be included.

The Precinct Commissions should be composed of residents of different communities (not from the community of the Precinct where they are assigned). This will promote impartiality and fairness.

The law should clearly define the principle of distribution of roles/functions among Precinct Commission members in every two-hour round on the election day.

Extensive trainings (preferably, one-month-long) should be provided for members of the Precinct Electoral Commissions (PEC). As a result, they are expected to get well-aware of Electoral Code, CEC decisions and their roles within PECs.

To avoid unnecessary bureaucracy, it should be defined that the CEC decision N°37 is applicable only to those, who have not acquired accreditation according to the CEC decision N°36 (both decisions made on July 29, 2011).

The procedures and boundaries of interactions between the PECs and Police should be narrowed down and precised.

Ballot lists of candidates should include also an option "Against all".

The HCAV insists to review the regulations on PEC composition. It recommends that members of PEC should not be related to the communities where the Precinct of their assignment is located.

To withdraw the requirement of taking a qualification exam for being allowed to carry an observation mission and to accredit an organization for observation mission based on its official statute.

Complaints and appeals on electoral violations revealed by observers should be properly addressed and eliminiated despite whose right is violated and who is the applicant.

The law should define that an organisation deploying an observation mission bears the responsibility for engaging quality and unbiased observers and for proper and objective implementation of the mission. The CEC can define administrative sanctions for breaching the principle of observation impartiality by particular observers.

Precinct Electoral Commissions' members should be provided with extensive and lasting professional trainings to insure their full competence on legal requirements and specificities of electoral process.

Precinct Electoral Commissions should be composed of members of the other communities rather than where the precinct is located, to reduce illigal influence on election administration and to insure increase of professionalism and impartiality of the electoral process/administration.

The order of changes (rotation?) of PEC members should be clearly defined and met the law requirements.

The law forsee who can be in precinct during vote counting and resuling the results but it should also clarify when and how they can enter a precinct. There is a gap on this in the law.

The line "Against All" should be added to the list of candidates in ballots of all local (municipal) and national suffrages regardless of the number of candidates and should start being considered as valid.

Lists of absent voters should be composed separately from general list of voters. Citizens from the Absent Voters List should vote according to the same regulations provided for diplomatic staffs and their families, as well as for those of legal persons registered in Armenia and residing in abroad. The Absent Voters' List should be published/posted in the precincts of their registered residence.

Instead of separating and classifying the voting lists of military servicemen, their names should be disperse in general lists of voters in order to prevent multiple voting through additional lists.

The signed lists of voters should be published after the vote to let the public see who has indeed voted.
